A man was killed in his rented room early this morning as a suspected drunk driver appears to have lost control of his car and plowed into the home of two men on an otherwise quiet residential street in Mission Viejo, California. The other home resident was not injured and authorities indicated the victim was dead upon the arrival of paramedics after he was crushed by the car entering his bedroom. Photographs and video of the incident shows the car almost completely inside the single family home.
Area residents told reporters that people often drive this stretch of road a high rates of speed as it is a downhill slope, but the little is known yet about the cause of this tragic accident. The driver, who is only known as the man driving the red Cadillac, is facing charges of DUI causing death, vehicular manslaughter, gross vehicular manslaughter while intoxicated and possibly even murder. Conviction for such charges could result in substantial prison time and even the possibility of life in prison.
Watson murder or the theory of implied malice in DUI related murder cases is often based upon a driver’s past criminal history. If a person has been previously convicted of DUI or a DUI related charge, they are more likely to be charged with murder in a subsequent case. This is true because they have often been formally advised by a judge or prosecutor about the dangers of driving while under the influence of alcohol.
