Handling Your DMV Hearing in California

When you are arrested for DUI the police officer will confiscate your license and is authorized by the law to issue you a temporary license that is good for only 30 days along with the notice of impending suspension. Once this occurs you only have ten days to contact the DMV to schedule a hearing in order to attempt to keep your license from being revoked. If you fail to schedule this hearing, your suspension will become effective automatically after the 30 days are up.

At our offices we pride ourselves on our success with DMV hearings. Note: If you don’t ask for a hearing in person, your hearing may be set with a foreign DMV office. I recently requested a hearing and was about to be scheduled with a Stockton, California hearing officer. I don’t know any hearing officers in Stockton, I’ve never done a hearing with the Stockton office and if I need to subpoena a witness, I don’t want to be driving or flying to Stockton to conduct a hearing that should be held locally in Van Nuys, El Segundo or Commerce.

Commercial drivers must especially beware when charged with a DUI. A DUI conviction can result in the loss of the commercial license for one year. A second major violation can cause a loss of commercial license for life. I will say that again — A second DUI in your lifetime will cause a lifetime revocation of a commercial license.
