DMV Hearings are an integral part of our practice at the Law Offices of Jeffrey S. Vallens. When you are arrested for DUI the police officer will confiscate your license and is authorized by the law to issue you a temporary license that is good for only 30 days along with the notice of impending suspension. Once this occurs you only have ten days to contact the DMV to schedule a hearing in order to attempt to keep your license from being revoked. If you fail to schedule this hearing, your suspension will become effective automatically after the 30 days are up.
At our offices we pride ourselves on our success with DMV hearings. If you do not have a DUI defense attorney for this hearing, your chance of any success in preventing your license suspension is almost nonexistent. We encourage all our clients to let us set and conduct DMV hearings on their behalf. Remember, if you don’t fight it, you can’t win it. If you don’t request a hearing, you will automatically lose. At this stage it is still possible to prevent your license from being suspended, provided you have the right defensive strategy. We may lose your hearing, but we won’t ever go down without a fight.
Although you can choose to have your DMV Hearing over the phone, we recommend you schedule it in person, with your DUI attorney present. The hearing will be held at a local DMV Driver’s Safety Office, where a Hearing officer will act as both the judge and the prosecutor. Issues to be discussed will include whether you were lawfully arrested and if your blood alcohol content was over the legal limit of .08%. Our strategy will be to challenge the procedures in order to attempt to overturn your license suspension.
Note: If you don’t ask for a hearing in person, your hearing may be set with a foreign DMV office. I recently requested a hearing and was about to be scheduled with a Stockton, California hearing officer. I don’t know any hearing officers in Stockton, I’ve never done a hearing with the Stockton office and if I need to subpoena a witness, I don’t want to be driving or flying to Stockton to conduct a hearing that should be held locally in Van Nuys, El Segundo or Commerce.
Commercial drivers must especially beware when charged with a DUI. A DUI conviction can result in the loss of the commercial license for one year. A second major violation can cause a loss of commercial license for life. I will say that again — A second DUI in your lifetime will cause a lifetime revocation of a commercial license.
